ESS Group Website Terms & Conditions

  1. Introduction

These Terms and Conditions (“Terms”) apply to all users of websites operated by ESS Group, which includes ESS Ltd., Eirdata, PREMA, Critical Airflow and Predictive Maintenance and Reliability Ireland. By accessing or using any of these websites, users agree to be bound by these Terms. References to “we”, “us”, or “our” refer to the ESS Group entities as applicable. These Terms govern the use of our products and services, including but not limited to training, outsourcing, consultancy, conditional and environmental monitoring, software subscription offerings and event production.

  1. Scope of Services

ESS Group provides a range of services through its entities:

  • ESS Ltd. delivers:
    • Training courses (in-person or online) across relevant public and private sector.
    • Consultancy services including:
      • asset care management, and
      • talent outsourcing and recruitment.
    • Eirdata offers:
      • Cleanroom Validation, Commissioning & Compliance Services
      • Environmental compliance services, including air quality monitoring and reporting.
      • Hardware solutions, such as air quality monitors and related instruments
    • PREMA provides:
      • Software products on a subscription basis (typically 12 months), including access, updates, support services and on site facilitated assessments.
    • Critical Airflow delivers:
      • Airflow control systems and solutions for cleanrooms, laboratories, and controlled environments
      • Installation, calibration, and maintenance of airflow monitoring equipment
      • Technical consultancy related to airflow performance, compliance, and safety standards.
    • Predictive Maintenance provides:
      • Condition monitoring products services and sales.
  1. Payments, Refunds & Cancellations

Unless otherwise agreed in writing, payment for all products and services provided by ESS Group is due within 30 days of the invoice date.

For training courses delivered by ESS Ltd:

  • Written notice of cancellation must be received at least 14 days before the course start date for a refund.
  • Cancellations received 14 days or fewer before the course are non-refundable.
  1. User Responsibilities

By engaging with ESS Group services, users agree to:

  • Provide accurate and up-to-date information during registration or agreements.
  • Comply with course requirements, including attendance, participation, and conduct.
  • Cooperate with consultancy or compliance services by supplying access and relevant documentation.
  • Use PREMA software according to licensing terms—no sharing, reverse-engineering, or redistribution.
  • Maintain confidentiality of proprietary materials, reports, and software.
  • Promptly report technical, billing, or other issues to the relevant ESS Group entity.

Failure to comply may lead to suspension or termination of services without liability to ESS Group.

  1. Intellectual Property

All content, documentation and materials provided through ESS Group services—such as training, reports, monitoring data, and software—are the intellectual property of the relevant entity.

Unless authorised in writing:

  • Users may not reproduce, distribute, modify, or create derivative works.
  • Software products from PREMA are licensed (not sold) and remain the property of PREMA and its licensors.
  • Materials are for internal use only and must not be shared externally.

All trademarks and branding remain the property of ESS Group or their respective owners.

  1. Privacy & Data Handling

ESS Group protects user data in line with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018. We collect and use personal data only for specific, lawful purposes related to service delivery.

  1. Liability & Disclaimers

While we aim for accuracy and reliability, to the fullest extent permitted by law:

  • Training courses are educational and don’t guarantee certification or employment.
  • Consultancy services are based on the conditions and information available at the time.
  • Environmental data and hardware provide indicative results and are not legally binding unless otherwise agreed.
  • PREMA software is provided “as is” without guarantees of uninterrupted service or suitability for specific purposes.
  • Predictive Maintenance provides its services “as is” and accepts no responsibility for any damages arising from their use. Users remain responsible for ensuring that any reliance on the information provided is appropriate for their circumstances.
  1. Termination & Suspension

ESS Group may suspend or terminate services, with or without notice, in cases of:

  • Breach of these Terms or other agreements
  • Late payments despite reminders
  • Misuse of services or materials
  • Abusive, disruptive, or damaging conduct

Users may terminate services by giving written notice, subject to any stated cancellation periods.

Upon termination:

  • Access to services may be disabled.
  • Any unpaid fees become immediately due.
  1. Jurisdiction & Governing Law

These Terms and any related disputes are governed by Irish law and subject to the exclusive jurisdiction of the courts of Ireland.
